Terms of Service

1. Acceptance of Terms
By accessing or using the Atlantis platform (the "Service"), provided by Neptune Customs LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.
2. Eligibility & Compliance
To use our Service, you must:
- Be at least 18 years of age.
- Not be located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.
- Not be listed on any U.S. Government list of prohibited or restricted parties (e.g., the OFAC Specially Designated Nationals and Blocked Persons List).
- Complete all required Know Your Customer (KYC) and Anti-Money Laundering (AML) verification processes.
3. Description of Service
Atlantis provides a computation power (hashrate) rental service. You are renting specialized hardware performance for a specified duration to participate in Bitcoin mining.
Important: This is a computation rental service, not a financial investment, security, or deposit. We do not guarantee mining distributions or profitability. Mining is subject to network difficulty, hardware uptime, and market fluctuations.
4. Payments & Payouts
- Rental Fees: All fees for hashrate rentals are paid upfront via Stripe. These fees are non-refundable except as expressly stated in the Hardware Rental Agreement.
- Payout Structure: Any Bitcoin distributions generated by the rented hardware are distributed according to Section 2 of the Hardware Rental Agreement.
- Fees: A 20% maintenance fee is deducted from gross distributions. Additional processing fees apply based on your selected payout method (PayPal, ACH Standard, or Same-Day ACH).
- 90-Day Verification Deadline: You must complete all KYC and tax documentation within 90 days of a block win to receive a payout. Failure to do so will result in the forfeiture of the distribution.
5. Tax Obligations
You are solely responsible for any tax liability arising from Bitcoin distributions. While Neptune Customs LLC does not currently issue tax documentation (such as Form 1099-NEC) for distributions, we reserve the right to request appropriate tax documentation from you (e.g., Form W-9 or W-8BEN) as required by future regulations or internal compliance before processing any distribution.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEPTUNE CUSTOMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, INCLUDING LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM HARDWARE DOWNTIME, NETWORK DIFFICULTY INCREASES, OR BTC PRICE VOLATILITY.
7. Governing Law & Dispute Resolution
These terms are governed by the laws of the State of Michigan, without regard to its conflict of law principles.
Mandatory Arbitration: Any dispute arising out of or relating to these terms or the Service shall be settled by binding arbitration in Wayne County, Michigan, in accordance with the rules of the American Arbitration Association (AAA). You waive your right to a jury trial or to participate in a class-action lawsuit.
8. Modifications
We reserve the right to modify these Terms of Service at any time. We will provide at least 7 days' notice for material changes. Your continued use of the Service after such changes constitutes acceptance of the new terms.
